These terms govern your use of the DateOptimizer Chrome extension and website (dateoptimizer.com). By installing the extension or using the website, you agree to these terms.
1. What DateOptimizer Is
DateOptimizer is a browser extension that tracks your activity on Tinder Web to provide analytics and profile optimization insights. It is an independent tool and is not affiliated with, endorsed by, or connected to Tinder or Match Group Inc. in any way.
2. Eligibility
You must be at least 18 years old to use DateOptimizer. By using the extension, you confirm that you meet this requirement.
3. Your Account
You provide an email address during setup. You are responsible for any activity associated with your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
You agree not to:
- Use DateOptimizer for any unlawful purpose.
- Reverse engineer, decompile, or modify the extension's source code for commercial redistribution.
- Attempt to access other users' data or accounts.
- Use the extension to harass, spam, or harm others on dating platforms.
- Misrepresent the data or insights provided by DateOptimizer.
5. Data and Privacy
Your use of DateOptimizer is also governed by our Privacy Policy, which explains what data we collect and how we use it. By using DateOptimizer, you consent to the collection and use of data as described in the Privacy Policy, including the use of anonymized, aggregated data for published insights.
6. Intellectual Property
DateOptimizer, including its code, design, branding, and content, is the property of DateOptimizer and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the extension for personal, non-commercial purposes.
7. Third-Party Platforms
DateOptimizer interacts with Tinder Web (tinder.com). We are not responsible for changes Tinder makes to its platform that may affect the extension's functionality. Your use of Tinder is governed by Tinder's own terms of service. Use of DateOptimizer is at your own risk with respect to any third-party platform's terms.
8. Service Availability and Termination
We strive to keep DateOptimizer available and functional, but we do not guarantee uninterrupted service. The extension depends on Tinder's DOM structure, which may change without notice. We may update, modify, or discontinue features or the entire service at any time, for any reason, without liability to you. We may also suspend or terminate your account at our sole discretion, with or without notice, for any reason including but not limited to violation of these terms.
9. Pricing and Payments
DateOptimizer is currently offered free of charge. We reserve the right to introduce paid tiers or features in the future. If we do, existing free users will be notified in advance and will retain access to a free tier of functionality. No charges will be made without your explicit consent.
10. Disclaimer of Warranties
DateOptimizer is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the extension will improve your match rate, that the data collected is 100% accurate, or that the extension will be compatible with future versions of Chrome or Tinder.
11. Limitation of Liability
To the maximum extent permitted by law, DateOptimizer and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the extension. This includes, but is not limited to, loss of data, loss of matches, account suspensions on third-party platforms, or any other damages. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim (if any).
12. Indemnification
You agree to indemnify, defend, and hold harmless DateOptimizer and its creators, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the extension, (b) your violation of these terms, (c) your violation of any third-party terms of service (including Tinder's), or (d) any dispute between you and a third party relating to your use of DateOptimizer.
13. Dispute Resolution and Arbitration
Any dispute arising from these terms or your use of DateOptimizer shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in Puerto Rico. You agree to resolve disputes on an individual basis only — you waive any right to participate in a class action, class arbitration, or representative proceeding. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
For claims under $1,000, arbitration may be conducted entirely online. For claims under $10,000, you may choose between online or in-person arbitration. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement.
14. Compliance with Third-Party Platforms
DateOptimizer is an independent analytics tool. We make no guarantees that your use of the extension complies with Tinder's terms of service or any other third-party platform's policies. If a third-party platform requests that we cease operations, modify our service, or remove data, we may comply without liability to you. You use the extension at your own risk with respect to third-party platform rules.
15. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or a notice in the extension. Continued use after changes constitutes acceptance of the updated terms.
16. Governing Law
These terms are governed by the laws of the Commonwealth of Puerto Rico, United States, without regard to conflict of law principles.
